RR Brush Brothers, LLC (“Contractor”) agrees to furnish the labor, materials, and supplies necessary to perform the painting and related services described in the approved proposal. The Customer agrees to pay the Contractor the price stated in the proposal according to these Terms of Service.

DEPOSIT AND PAYMENT

A 20% deposit and approval of the proposal are required to reserve the project date. The deposit will be applied toward the total project price. The remaining balance is due immediately upon substantial completion of the contracted work. Minor touch-ups or warranty requests do not permit the Customer to withhold final payment.

CHANGES TO THE SERVICES

Any changes or additions to the services described in the proposal must be approved in writing by both the Customer and Contractor. The Customer understands that requested changes may result in additional charges and may delay the anticipated completion date. Text messages, emails, electronic approvals, and signed change orders may serve as written authorization.

SCHEDULING AND DELAYS

Project start and completion dates are estimates. If the Contractor is unable to begin or complete the work because of circumstances beyond its reasonable control—including weather, fire, flood, acts of God, vandalism, material delays, unsafe conditions, emergencies, or delays caused by the Customer or other contractors—the Contractor will not be considered in breach of the agreement. The schedule will be extended by a reasonable amount of time necessary to complete the work.

CUSTOMER RESPONSIBILITIES

The Customer must provide reasonable access to the property, electricity, running water, and a safe working environment. Before work begins, the Customer must remove valuables, fragile items, wall decorations, and small personal belongings from the work areas and keep children safely away.

Moving heavy furniture, appliances, electronics, pianos, safes, aquariums, or specialty items is not included unless specifically stated in the proposal.

PETS AND ANIMALS

The Customer is responsible for the care, supervision, and safety of all pets and animals at the property. Before and during the work, pets must be secured away from all work areas, equipment, materials, and entrances used by the Contractor.

The Contractor is not responsible for supervising pets or for any pet that escapes, enters a work area, comes into contact with paint or materials, damages completed work, or is injured because it was not properly secured. Any additional work required because of pet-related damage may result in additional charges.

SURFACE CONDITIONS AND PREPARATION

The Contractor will perform the surface preparation specifically described in the proposal. Painting may not completely conceal existing cracks, dents, texture variations, previous repairs, water damage, uneven surfaces, or defects in prior coatings.

Major drywall, plaster, carpentry, mold, moisture, rot, rust, or structural repairs are not included unless specifically stated in the proposal. Hidden conditions discovered after work begins may require additional work, charges, and time.

COLORS AND PAINT COVERAGE

The Customer is responsible for approving all paint colors and sheen levels before materials are purchased or applied. The Contractor is not responsible for differences in how colors appear because of lighting, surrounding finishes, or screen and sample variations.

Color changes requested after paint has been purchased or applied may result in additional charges. The number of coats included will be stated in the proposal. Additional coats required because of drastic color changes, poor coverage, bright or deep colors, or Customer-selected products may be charged separately.

SAFETY PRECAUTIONS

The Contractor will take reasonable safety precautions while performing the work. The Customer agrees to avoid restricted work areas and not interfere with ladders, equipment, tools, coverings, or freshly painted surfaces. Children, pets, occupants, and visitors must remain safely away from active work areas.

WORKMANSHIP WARRANTY

The Contractor provides a one-year workmanship warranty covering peeling, flaking, or blistering paint caused by defective workmanship. The warranty begins on the date of substantial completion.

The warranty does not cover horizontal or walked-on surfaces; rusty or corroded surfaces; moisture, leaks, condensation, mold, mildew, rot, structural movement, or failing underlying coatings; ordinary wear and tear; scratches, scuffs, impact, misuse, or damage caused by the Customer, occupants, children, pets, cleaners, movers, or other contractors; Customer-supplied materials; manufacturer or product defects; fading; or weather-related damage.

Warranty concerns must be reported to the Contractor in writing. The Contractor must be given a reasonable opportunity to inspect the affected area and correct any work covered by the warranty. The warranty is limited to repairing the affected covered area.

FINAL WALKTHROUGH, TOUCH-UPS, AND ACCEPTANCE

Upon substantial completion of the work, the Contractor will conduct a final walkthrough with the Customer to review the completed services and confirm that the work described in the approved proposal has been completed to the Customer’s satisfaction. The Customer should identify any reasonable touch-ups during this walkthrough.

When possible, the Contractor will complete the touch-ups at that time. If additional time or a return visit is needed, the Contractor will schedule the touch-ups within a reasonable timeframe.

Following the final walkthrough, the final invoice will be issued and payment will be due immediately, regardless of whether the Contractor needs to return for minor touch-ups. Any remaining approved touch-ups will still be completed and will not be considered waived because final payment has been made.

ENTIRE AGREEMENT

The approved proposal, these Terms of Service, and any approved written change orders constitute the complete agreement between the Customer and Contractor. Any verbal promises or understandings not included in writing are not binding. Electronic approval or signature constitutes acceptance of these Terms of Service.
